Most certificates pay your lawyer&#8217;s fees and expenses, but some pay only expenses. You can get a certificate for some types of legal problems, but not all.<\/p>\n<p class=\"titles\"><i>Legal Aid Ontario<\/i> (&#8220;legal aid&#8221;) receives funding from the provincial government to provide legal services to people with low incomes. Legal aid has two main components:<\/p>\n<ul>\n<li>The <strong>community legal clinic system<\/strong>; and<\/li>\n<li>The <strong>legal aid certificate program<\/strong>.<\/li>\n<\/ul>\n<p>Community legal clinics are staffed by family law lawyers, community legal workers and sometimes law students. Legal clinics provide representation and advice on various kinds of legal issues. To receive services from a clinic, you must live in the area it serves. Most clinics also provide brief advice, or &#8220;summary advice&#8221;, without asking about your financial situation.<\/p>\n<p>In family law, legal aid covers the following areas:<\/p>\n<ul>\n<li>To <strong>obtain custody of your children or change custody<\/strong><\/li>\n<li>To get <strong>access for you to see your children<\/strong> or to make a <strong>major change to access arrangements<\/strong> that have already been made<\/li>\n<li>To <strong>assist you if your partner denies you access<\/strong> to your children<\/li>\n<li>To obtain<a href=\"https:\/\/toronto-familylawyer.com\/child-support-lawyer-toronto\/\"><strong> child support<\/strong><\/a> or increase or decrease support<\/li>\n<li>To obtain <a href=\"https:\/\/toronto-familylawyer.com\/spousal-support-lawyer-toronto\/\"><strong>spousal support<\/strong><\/a> or increase or decrease spousal support<\/li>\n<li>To stop your partner from selling or destroying your <a href=\"https:\/\/toronto-familylawyer.com\/division-of-property-in-divorce\/\"><strong>property<\/strong><\/a><\/li>\n<li>To <strong>negotiate ownership<\/strong> of things like RRSPs or pensions that could provide you with some income<\/li>\n<li>To assist you get a <strong>restraining order<\/strong> against your partner<\/li>\n<li>To assist you get exclusive <strong>possession of the matrimonial home<\/strong>.<\/li>\n<\/ul>\n<h2>Will Legal Aid Pay for My Divorce or Child Support Case?<\/h2>\n<p>You can get legal aid to pay for a lawyer if:<\/p>\n<ul>\n<li>You have little or no money left after you pay for necessities; and<\/li>\n<li>Your legal problem is one that legal aid covers.<\/li>\n<\/ul>\n<p>When you go to a legal aid office to apply for legal aid certificate <strong>you should take as much information as possible<\/strong> including:<\/p>\n<ul>\n<li><strong>Court papers<\/strong>, if you have been served with any<\/li>\n<li>Identification documents<\/li>\n<li><strong>Proof of your current income<\/strong> i.e. 3-4 recent pay stubs, income tax return or notice of assessment for previous year; welfare statement of income or employment insurance statements<\/li>\n<li><strong>Up-to-date bank books<\/strong><\/li>\n<li><strong>Proof of monthly expenses and bills<\/strong> (rent receipt or mortgage payment, hydro, gas, car payments receipts, credit card statements, car insurance bill)<\/li>\n<li><strong>Deed for your house<\/strong><\/li>\n<li><strong>Proof of any unusual expenses<\/strong> such as medical costs.<\/li>\n<\/ul>\n<p>If legal aid decides that you have enough money to pay a lawyer yourself, you will not be given a certificate. If you get a certificate, you may be required to sign a payment agreement.
